Rubbish Removal Richmond Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Richmond provides rubbish removal and related waste collection services. By making a booking, accepting a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

These terms are intended to protect both you and us, and to ensure that rubbish removal and waste handling is carried out safely, efficiently, and in accordance with applicable laws and regulations within the United Kingdom.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "Company", "we", "us" and "our" mean Rubbish Removal Richmond, the provider of rubbish removal and waste collection services.

1.2 "Customer", "you" and "your" mean the individual or business requesting and paying for our services.

1.3 "Services" means any rubbish removal, waste collection, bulky waste clearance, garden waste removal, house or office clearance, loading, transport and disposal services provided by us.

1.4 "Waste" means any items, materials or substances that you ask us to remove, including general household waste, commercial waste, furniture, appliances, garden waste and other non-hazardous items that we agree to collect.

1.6 "Booking" means a confirmed arrangement between you and us for the provision of Services at a specified time, date and location.

2. Scope of Services

2.1 Our Services typically include the collection, loading, transportation and lawful disposal or recycling of waste from residential and commercial properties in and around the Richmond area and other areas we may cover from time to time.

2.2 We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, illegal to handle or transport, or outside the scope of the Services we normally provide.

2.3 Any verbal or written descriptions of our rubbish removal services, including approximate volumes, weights or load sizes, are given as a guide only and do not form a guarantee unless expressly set out in writing in the Booking confirmation.

3. Booking Process

3.1 You may request a quotation or make a Booking by telephone, email or through any other communication method we make available.

3.2 In order to provide an accurate quotation for rubbish removal or waste collection, we may ask you for information regarding the nature, quantity, access and location of the waste, including photographs or an itemised list.

3.3 Any quotation provided prior to our arrival is an estimate only and is subject to confirmation once our operatives have inspected the waste on site. We will notify you of any change in price before commencing the Service.

3.4 A Booking will be treated as confirmed once you have accepted our quotation and we have allocated a time slot and date for the rubbish removal or clearance service. We may send you a confirmation by email, text message or other communication method.

3.5 You are responsible for ensuring that all details provided at the time of Booking are complete and accurate, including contact details, address, access information, parking availability and any relevant restrictions for the collection site.

4. Access and Parking

4.1 You must ensure that our operatives have safe, reasonable and lawful access to the property and to the waste that is to be removed at the agreed time.

4.2 Where parking restrictions apply, it is your responsibility to arrange suitable parking or permits for our vehicles. Any parking charges, penalties or fines incurred due to insufficient parking arrangements may be charged to you in addition to the service fee.

4.3 If access to the waste or property is obstructed or unsafe, we may, at our discretion, refuse to carry out the Service or charge for additional time spent resolving access issues.

5. Customer Responsibilities

5.1 You must ensure that all waste intended for collection is clearly identified and separated from any items that you wish to keep.

5.2 You should remove or secure any personal or sensitive items that you do not wish to be taken away during the rubbish removal process.

5.3 You must inform us in advance of any items that may require special handling, such as electrical appliances, large or heavy objects, or items containing liquids.

5.4 You must notify us prior to the Booking if there is any Hazardous Waste or potentially dangerous material on site. We are not authorised to handle certain types of waste and will refuse to remove them if discovered.

6. Pricing and Quotations

6.1 Our charges are generally based on the volume and type of waste removed, the weight of the load where applicable, the labour involved and any additional services required, such as dismantling or extra time on site.

6.2 Any quotation given in advance of a site visit is an estimate based on the information you have provided. If on arrival the actual waste differs in volume, weight or nature, or if access conditions are more difficult than described, we reserve the right to revise the price accordingly.

6.3 We will explain any price variations to you before commencing the Service. If you do not accept the revised quotation, we may cancel the Service and no charge will be made other than any call-out fee agreed in advance.

6.4 All prices quoted are exclusive of any applicable taxes, charges or government levies unless otherwise stated. Any applicable taxes will be added to the final invoice where required by law.

7. Payments

7.1 Unless otherwise agreed in writing, payment for our rubbish removal or waste collection Services is due in full immediately upon completion of the work on the day of service.

7.2 We accept payment by cash, debit card, credit card or other methods that we may specify from time to time. For business customers, account or invoice terms may be available by prior written agreement.

7.3 Invoices issued on credit terms must be paid in full within the payment period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

7.4 If you fail to make payment on time, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing late payment, including legal and debt collection costs.

8. Cancellations and Amendments

8.1 You may cancel or amend a Booking by contacting us by telephone or email.

8.2 If you cancel your Booking more than 24 hours before the scheduled start time, no cancellation fee will normally be charged.

8.3 If you cancel within 24 hours of the scheduled start time, or if you fail to be present or provide access when our operatives arrive, we reserve the right to charge a cancellation fee or call-out fee to cover our costs and loss of opportunity.

8.4 We may, at our discretion and subject to availability, agree to reschedule a Booking without charge where reasonably possible.

8.5 We reserve the right to cancel or reschedule a Booking due to circumstances beyond our reasonable control, including but not limited to severe weather, traffic conditions, vehicle breakdowns, staff illness or safety concerns. In such cases, we will use reasonable endeavours to notify you as soon as practicable and to arrange an alternative time for the rubbish removal or collection.

9. Waste Regulations and Compliance

9.1 We operate in accordance with applicable UK waste management and environmental legislation and aim to handle rubbish and waste responsibly, prioritising reuse and recycling where practicable.

9.2 We will transport waste only to authorised disposal, recycling or treatment facilities and will take reasonable steps to ensure waste is processed lawfully.

9.3 We may issue you with a waste collection note or similar documentation upon request, confirming that your rubbish has been collected for disposal or recycling.

9.4 You agree not to request us to remove any items that are illegal to possess, handle, transport or dispose of, including stolen goods or illicit substances. If such items are identified, we may report this to the appropriate authorities.

9.5 Where we encounter Hazardous Waste, we may refuse to remove it and may advise you to engage a specialist licensed contractor. We accept no liability for any costs arising from your need to arrange alternative removal for Hazardous Waste.

10. Liability and Damages

10.1 We will exercise reasonable care and skill when providing our rubbish removal and waste collection Services. However, you acknowledge that clearance work can involve heavy lifting and movement of bulky items, and that certain risks may be present.

10.2 You should ensure that any fragile items, valuables, or delicate surfaces are protected or removed from areas where our operatives will be working. We do not accept responsibility for minor cosmetic damage such as scuffs or marks which may occur during the normal course of moving large items, unless caused by our negligence.

10.3 Our total liability to you in respect of any loss or damage arising out of or in connection with the provision of the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by you for the specific Service giving rise to the claim, except where liability cannot lawfully be limited.

10.4 We shall not be liable for any indirect or consequential loss, loss of profits, loss of business or loss of opportunity arising out of our provision of rubbish removal or waste collection services.

10.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where it would be unlawful to do so.

11. Insurance

11.1 We maintain public liability insurance and any other insurance cover that we consider appropriate for the provision of our Services.

11.2 Details of our insurance cover, including the level of indemnity, may be made available upon request.

12. Customer Property and Title to Waste

12.1 You are responsible for ensuring that only items that you intend to discard are presented for rubbish removal. Once our operatives have loaded items onto our vehicle, those items will generally be treated as waste and will not be retrievable.

12.2 Title to and responsibility for the waste passes to us at the point at which we load it onto our vehicle, subject to our right to refuse any items that we reasonably consider unsuitable for collection.

12.3 We do not accept any responsibility for items removed in error where the items were not clearly separated or identified as not for disposal.

13. Health and Safety

13.1 We are committed to carrying out our rubbish removal and waste collection services safely and in compliance with relevant health and safety laws.

13.2 You agree to provide a safe working environment for our operatives, including notifying us of any known hazards at the property, such as structural defects, broken glass, exposed nails, or aggressive animals.

13.3 If our operatives consider that any situation on site presents an unacceptable risk to health or safety, we reserve the right to suspend or cancel the Service until the risk has been removed or mitigated.

14. Data Protection and Privacy

14.1 We will collect and use personal information about you only as necessary to manage your Booking, provide our Services, process payments and meet our legal obligations.

14.2 We will handle your personal data in accordance with applicable data protection laws and will take appropriate measures to protect it against unauthorised access, loss or misuse.

15. Complaints and Disputes

15.1 If you are dissatisfied with any aspect of our rubbish removal or waste collection services, you should notify us as soon as possible so that we can attempt to resolve the issue promptly.

15.2 We will investigate all complaints in good faith and may request additional information, including photographs or a written description of the problem.

15.3 Any disputes arising from these Terms and Conditions or from the provision of our Services that cannot be resolved directly between you and us may be referred to mediation or other alternative dispute resolution methods where both parties agree.

16. Changes to Terms and Conditions

16.1 We may amend these Terms and Conditions from time to time to reflect changes in law, best practice or our internal procedures.

16.2 The version of the Terms and Conditions that applies to your Booking will generally be the version in force at the time you make the Booking, unless we agree otherwise with you in writing.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by and shall be interpreted in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish removal and waste collection services.

18. General Provisions

18.1 If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court or other competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.

18.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

18.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide our waste collection and rubbish removal services.

18.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of our Services and supersede any previous agreements or understandings, whether written or oral.
